Terms & Conditions
1. Scope of Services
1.1 StaySaver is a digital platform that enables hotels to list and sell Day Use Rooms, short-stay rooms, and related hospitality services to users.
1.2 StaySaver acts solely as a technology and marketing intermediary and does not own, operate, manage, or control any hotel or accommodation.
1.3 Hotels remain fully responsible for guest experience, room availability, pricing accuracy, and service delivery.
2. Hotel Eligibility & Onboarding
2.1 Hotels must be legally registered businesses with valid licenses, permits, and approvals required by local, state, and national authorities.
2.2 Hotels agree to provide accurate and up-to-date information including:
- Property name and address
- Room categories and amenities
- Check-in / check-out or day-use time slots
- Pricing and applicable taxes
- Contact details
2.3 StaySaver reserves the right to approve, reject, suspend, or remove any hotel listing at its sole discretion.
3. Listings, Pricing & Availability
3.1 Hotels are solely responsible for setting day-use pricing, managing room inventory, and preventing overbooking.
3.2 Prices listed on StaySaver must be honored without discrimination against StaySaver guests.
3.3 Any changes to pricing or availability must be promptly updated through the StaySaver dashboard or shared with the StaySaver team.
4. Booking & Guest Handling
4.1 All confirmed bookings received via StaySaver must be accepted and honored by the hotel.
4.2 Hotels must provide the same standard of service to StaySaver guests as provided to direct or walk-in guests.
4.3 Hotels shall not:
- Deny confirmed StaySaver bookings
- Demand additional mandatory charges not disclosed at booking
- Redirect guests to alternative properties without approval
5. Payments & Commission
5.1 StaySaver may operate on a commission-based model or a net rate/markup booking model, as mutually agreed in writing.
5.2 Hotels are responsible for all applicable taxes, GST/VAT, service charges, and statutory compliance.
6. Cancellations & No-Shows
6.1 Cancellation and no-show policies will be defined by the hotel and displayed to users at the time of booking on the StaySaver App.
6.2 Hotels must strictly adhere to the agreed cancellation policy.
6.3 StaySaver is not liable for losses arising from guest no-shows unless explicitly agreed otherwise.
7. Hotel Responsibilities
- Maintain cleanliness, safety, and hygiene standards
- Ensure rooms and amenities match listing descriptions
- Comply with local laws related to guest identification and security
- Provide correct invoices/receipts as per local authority requirements
8. Brand Usage & Marketing
8.1 Hotels grant StaySaver a non-exclusive, royalty-free right to use hotel name, logo, images, and descriptions for marketing purposes only.
8.2 StaySaver branding may optionally be displayed at the hotel for promotional purposes.
9. Data Protection & Privacy
9.1 Both parties agree to comply with applicable data protection and privacy laws.
9.2 Guest data shared via StaySaver shall be used only for reservation and service purposes.
9.3 Hotels shall not misuse, resell, or share guest data without lawful consent.
10. Limitation of Liability
10.1 StaySaver is not liable for hotel service quality, guest behavior, property damage, theft, or regulatory violations by the hotel.
10.2 Hotels agree to indemnify StaySaver against claims arising from service failure, legal non-compliance, or guest disputes.
11. Suspension & Termination
11.1 StaySaver may suspend or terminate partnerships for false information, repeated complaints, or legal/safety violations.
11.2 Either party may terminate the agreement with prior written notice as mutually agreed.
12. Force Majeure
Neither party shall be liable for failure to perform due to events beyond reasonable control including natural disasters, government actions, pandemics, or technical outages.
13. Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India. Courts of the applicable jurisdiction shall have exclusive authority unless otherwise agreed.
14. Amendments
StaySaver reserves the right to update these Terms & Conditions. Updates will be communicated via email or platform notifications.
15. Acceptance
By registering or continuing to list your property on StaySaver.app, you confirm that you have read, understood, and agreed to these Terms & Conditions.
